A BILL FOR AN ACT
RELATING TO ASSAULT
.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 707-710, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:
"(2) Assault in the first degree is a class B felony[.], unless committed against a pregnant person, in which case it is a class A felony."
SECTION 2. Section 707-711, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:
"(2) Assault in the second degree is a class C felony[.], unless committed against a pregnant person, in which case it is a class B felony."
SECTION 3. Section 707-712, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:
"(2) Assault in the third degree is a misdemeanor unless committed [in]:
(a) Against a pregnant person, in which case it is a class C felony; or
(b) In a fight or scuffle entered into by mutual consent, in which case it is a petty misdemeanor."
SECTION 4. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 5. Statutory material to be repealed is bracketed. New material is underscored.
SECTION 6. This Act shall take effect upon its approval.
