Repeals the 7/1/01 sunset date of Act 278, Session Laws of Hawaii 1999, to permanently eliminate the 30 percent cap on operating expenses of the Crime Victim Compensation Commission. Exempts the executive director and administrative assistant of the commission from the civil service law. Appropriates funds to compensate crime victims and their providers. A BILL FOR AN ACT

SECTION 1. Section 351—69, Hawaii Revised Statutes, is amended to read as follows:

"§351—69 Commission staff. Supervisory, administrative, and clerical personnel necessary for the efficient functioning of the commission shall be appointed as provided in section 26-35. An executive director and an administrative assistant shall be appointed, without regard to chapters 76 and 77, for the proper administration and enforcement of this chapter."

SECTION 2. Act 278, Session Laws of Hawaii 1999, is amended by amending section 7 to read as follows:

"SECTION 7. This Act shall take effect upon its approval; provided that Section 4 shall take effect on July 1, 1999[, and shall be repealed on July 1, 2001]."

SECTION 3. In accordance with Sections 37-92(b) and 37-92(h) of the Hawaii Revised Statutes, the governor has determined that the appropriations contained in this Act will cause the general fund appropriation ceiling of the executive branch to be exceeded in fiscal year 2001-2002, as appropriate by $450,000 or per cent. The reason for exceeding the executive general fund appropriation ceiling is to ensure that the public interest is served, and to meet the needs provided by this Act.

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $450,000 or so much thereof as may be necessary for fiscal year 2001-2002 to be deposited into the crime victim compensation special fund.

SECTION 5. There is appropriated out of the crime victim compensation special fund the sum of $450,000 or so much thereof as may be necessary for fiscal year 2001-2002 for the sole purpose of compensating certain persons or their providers of services pursuant to chapter 351, Hawaii Revised Statutes, by payments authorized by the crime victim compensation commission.

SECTION 6. The sums appropriated in sections 4 and 5 shall be expended by the department of public safety for the purposes of this Act.

SECTION 7. The crime victim compensation commission shall submit a report to the legislature at least twenty days prior to the convening of the regular session of 2002, that shall include but not be limited to the following:
