A BILL FOR AN ACT

 

relating to public safety.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that civil process servers serve subpoenas and other court processes. Any person can masquerade as a civil process server unless an identification badge is worn. The legislature believes that civil process servers should be conspicuously identified.

The purpose of this Act is to require civil process servers to wear identification badges and to carry wallet identifications provided by the department of public safety that designate them as a deputy sheriff-civil section.

SECTION 2. Chapter 353C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§353C- Deputy sheriffs; identification badges. (a) Every person authorized to make service of process and orders under section 634-21, shall wear an identification badge at all times while on duty, including while serving official documents under chapter 607. The badges shall have the name and photograph of the deputy sheriff, the designation "Deputy Sheriff-Civil Section". The badges shall be worn on the chest and be of a size that makes it clear and visible.

(b) Every deputy sheriff of the civil section shall carry a wallet size identification card with the same photograph and information as specified under subsection (a). The identification card shall be carried at the same time as the badge is worn.

(c) This section shall not apply to police officers of each county and regularly uniformed personnel of the department for whom badge and identification requirements already exist or any investigator appointed and commissioned by the director of commerce and consumer affairs pursuant to section 26-9(j)."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
