A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

PART I

SECTION 1. There is appropriated out of the general revenues of the State of Hawaii the following sums, or so much thereof as may be necessary, for fiscal biennium 2001-2003, for the following purposes:

1. Hire clerical personnel to assist public school special education teachers.

Total funding FY 2001-2002 $          

2. Two hundred ninety-two full-time equivalent (292.00 FTE), temporary, school clerical positions to partially implement the recommendations of the 1990 school and district office clerical staffing study; provided that the department of education shall allocate these temporary positions according to pupil enrollment.

Total funding FY 2001-2002 $          

3. At least one full-time equivalent (1.00 FTE) vice-principal position for each public school.

4. Reduce the student-to-counsel or ratio in public schools to 250 to 1 in grades kindergarten to twelve.

5. Maximize the establishment of networking centers in an equitable manner and further develop exiting networking centers

A. Two district coordinator positions, one each on Maui and Kauai. $52,000

B. Networking center facilitators at King Kaumualii elementary, Kapaa middle school, Iao intermediate, Maunaloa elementary, Pukalani elementary, Kamalii elementary, and King Kekaulike high schools of Kauai and Maui. $99,756

C. Forty-five schools ($11,232 per school) that are currently funded at $3,300 a year. $505,440

D. Forty schools ($14,532 per school) which have not received any funds. $581,280

E. Eight part-time parent liaison coordinators ($11,232 per coordinator) to demonstrate the efficacy of classroom-generated partnerships on student well-being and achievements in these eight schools, one per district plus Kona. $89,856

6. Convert the five temporary, half-time registrar positions at Waimanalo elementary and intermediate school, Mililani middle school, Konawaena middle school, Kapolei middle school, and Laupahoehoe high and elementary school to permanent, full-time status.

7. Convert twenty-five temporary, full-time registrar positions at Central middle school, Dole middle school, Jarrett middle school, Kaimuki middle school, Kalakaua middle school, Kawananakoa middle school, Niu Valley middle school, Stevenson middle school, Aiea intermediate school, Aliamanu intermediate school, Moanalua intermediate school, Hilo intermediate school, Kau high and Pahala elementary school, Keaau elementary and intermediate school, Kealakehe intermediate school, Kohala high and intermediate school, Waimea elementary and intermediate school, Waimea Canyon elementary and intermediate school, Kapaa middle school, Hana high and elementary school, Iao intermediate school, Lahaina intermediate school, Lanai high and elementary school, Lokelani intermediate school, and Maui Waena intermediate school, to permanent status.

8. Additional four permanent, full-time equivalent (4.00 FTE), registrar positions, one position each for Olomana school, Kauai community school for adults, Kona community school for adults, and Maui community school for adults.

9. One full-time student activities coordinator for each public high school hired on a twelve-month basis.

10. School club advisors with annual stipends of $300 and reimbursement for mileage relating to school club functions and projects at a rate of 10 cents per mile.

11. High school athletic training equipment and supplies.

12. Three additional permanent positions in the public affairs office of the department of education:

A. Two full-time equivalent (2.00 FTE) public relations specialists.

B. One full-time equivalent (1.00 FTE) clerk typist and;

The procurement of necessary consultant services and goods.

13. Raise the average salary of public school teachers in Hawaii, adjusted for cost of living, to the national average.

14. Establishment of vocational education programs in all public high school.

15. Interactive learning program.

16. Matching grant for the expansion of HO'OLANA program services for academically challenged students in grades 6 to 12 throughout the State.

17. Resources for Early Access to Learning (Families for R.E.A.L.) program to fund four sites in the following amounts:

A. One full-time parent educator. $36,000

B. One full-time early childhood educator. $36,000

C. One part-time temporary teacher. $15,000

D. Supplies, equipment, and other costs. $4,000

18. Operating costs of the Waikoloa After School Learning Center.

19. Development, implementation, and continuation of student crimestoppers programs in all departmental school districts to allow students to take action against victimization and crime and to create a safe and secure environment in and around public school campuses.

20. Establishment of an anti-smoking education program for children in public schools.

21. Development of a water safety and learn-to-swim program for public school students in the fourth grade; provided that:

A. The department of education may adopt a reasonable schedule of fees in accordance with chapter 91, Hawaii Revised Statues; and

B. Students shall be tested for swimming and drowning prevention skills as part of this program.

22. At least twenty-eight full-time equivalent (28.00 FTE) school-level positions within the department of education. There shall be at least:

A. One specialist in dance;

B. One specialist in drama;

C. One specialist in visual arts; and

D. One specialist in music,

In each of the seven departmental districts of the department of education.

23. Operating expenses of the Honolulu Symphony Orchestra to restore education programs on the neighbor islands and the Ohana Concert Series on Oahu

24. Expenses relating to the representation of Hawaii at the Festival of Pacific Arts by individuals active in Pacific Arts and Education.

25. Support for the Maui Arts and Cultural Center and its work in arts education with Maui community college and the department of education.

26. Restoration of a chamber music program to the community of Kailua.

27. Purchase computers for public high schools statewide, in order to increase the availability of computers, software, and universal Internet access to meet the needs of Hawaii's public high school students.

28. Interisland air and ground transportation expenses of students from the department of education Maui district athletics to participate in state athletic tournaments, off island games, field trips, and other student activities.

29. Lanai high and elementary school which is participating in the school/community-based management system to cover transportation costs.

30. Molokai participating in school/community-based management systems to cover transportation costs.

31. One fourteen-passenger van for Hana high school athletic programs.

32. Train security attendants for the department of education's school campuses and to provide ongoing training for current school security attendants.

33. Public access to computers and the Internet at public libraries.

34. One (1.0) full-time children's librarian for the Waimanalo Public Library.

SECTION 2. The sums appropriated by section 1 of this Act shall be expended for the purposes of this Act as follows:

(1) Items 1 through 22, 27, 28, 29, 30, 33, 34, 35, by the department of education;

(2) Items 23 and 25, by the department of accounting and general services;

(3) Items 24 and 26, by the state foundation on culture and the arts;

(4) Item 31, by the department of transportation; and

(5) Item 32, by the department of public safety.

PART II

SECTION 3. The director of finance is authorized to issue general obligations bonds in the sum of $          , or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal years 2001-2002, and 2002-2003, for the following projects:

1. Antone Vidinha Stadium Complex

A. Improvements $800,000

B. Rubberized Track $700,000

2. Waimea High School/District Swimming Pool

A. Plans/Design $50,000

B. Construction $550,000

Total funding FY 2001-2002 $550,000

3. Kokee Road Safety Improvements and Emergency Escape Ramps

Total funding FY 2001-2002 $600,000

4. Planning, design, land acquisition, and construction to expand the Makawao public library.

Total funding FY 2001-2002 $3,500,000

5. Expanding and improving the track and play field of Hana High School.

Total funding FY 2001-2002 $250,000

SECTION 4. The sums appropriated by section 3 of this Act shall be expended for the purposes of this Act as follows:

(1) Item 1, 2, and 5, by the department of education;

(2) Item 3, by the departments of transportation and land and natural resources; and

(3) Item 4, by the department of accounting and general services.

PART III

SECTION 5. The legislature finds that the Hawaii state student council has been functioning for many years. However, although the council is mentioned in the state constitution, it has never been formally established in statute. In establishing the council statutorily, this Act continues the operations of the existing council and requires it to:

(1) Determine its composition and governance policies;

(2) Select or run an election for the student member of the board of education; and

(3) Conduct an annual conference of secondary students.

SECTION 6. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

"§302A-   Hawaii state student council. (a) There is established within the department for administrative purposes the Hawaii state student council, which shall consist of representation from each departmental school district.

(b) The council shall conduct an annual conference of secondary school students.

(c) The annual student conference shall be held once each school year and shall not exceed three consecutive days. Whenever possible, the annual student conference shall be held within sixty days of the convening of a regular session of the legislature.

(d) The Hawaii state student council may also invite students from schools represented by the Hawaii Association of Independent Schools to participate in the planning of or to attend the conference.

(e) The department shall assign a staff member to assist the conference committee, including assistance in the planning and implementation of the conference and the drafting of the evaluation report, to be known as staff adviser to the conference committee."

SECTION 6. Chapter 317, Hawaii Revised Statutes, is repealed.

PART IV

SECTION 7. New statutory material is underscored.

SECTION 8. This Act shall take effect on July 1, 2001.
