A BILL FOR AN ACT
relating to dogs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Dogs in public parks and on public beaches. (a) Dogs shall be allowed in public parks and on public beaches during all hours of a day. This section shall apply to state and county parks and beaches.
(b) The handler of a dog that is allowed in a public park or on a public beach shall:
(1) Have control of the handler's dog at all times. The handler's dog shall be leashed except when performing at dog shows and during training in a dog obedience class or at trials;
(2) Pick up and dispose of all feces left by the handler's dog; and
(3) Obey all signs posted in the park or on the beach.
(c) Subsection (a) shall not apply to stray dogs, or to dogs running at large in public parks or on public beaches.
(d) Each county shall adopt rules in accordance with chapter 91, with respect to county parks and beaches, to carry out the purposes of this section. The board of land and natural resources shall adopt rules in accordance with chapter 91, with respect to state parks and beaches, to carry out the purposes of this section; provided that the rules adopted by the board shall be consistent with the rules adopted by each respective county."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the following sums, or so much thereof as may be necessary for fiscal year 2001-2002, to assist the counties in carrying out the purposes of this Act:

County of Honolulu $
County of Maui $
County of Hawaii $
Total $
The sums appropriated shall be expended by the counties of Kauai, Honolulu, Maui, and Hawaii, and shall constitute the State's share of the cost of mandated programs under article VIII, section 5 of the state constitution.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2001.
