A BILL FOR AN ACT
relating to the felix v. cayetano consent decree.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that there is a need to provide greater fiscal coordination with respect to the Felix v. Cayetano consent decree. The purpose of this Act is therefore to appropriate funds to establish a fiscal manager for Felix v. Cayetano consent decree compliance costs in the governor's office, who shall be exempt from civil service laws. All expenditures, disbursements, appropriations, and other data and related fiscal information incurred by the departments of education, health, human services, and the attorney general in connection with Felix v. Cayetano consent decree compliance costs are to be provided to the fiscal manager. The fiscal manager position may be filled by contract with a private accounting firm.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ , or so much thereof as may be necessary for fiscal year 2001-2002, for the establishment of one (1.0) full-time equivalent temporary position in the office of the governor for a fiscal manager for Felix v. Cayetano consent decree compliance costs; provided that:
(1) The fiscal manager shall be exempt from chapters 76, 77, and 89, Hawaii Revised Statutes;
(2) All expenditures, disbursements, appropriations, and other data and related fiscal information incurred by the departments of education, health, human services, and the attorney general in connection with Felix v. Cayetano consent decree compliance costs shall be provided to the fiscal manager;
(3) The fiscal manager position may be filled by contract with a private accounting firm consisting of certified public accountants; and
(4) The fiscal manager shall report annually to the legislature regarding Felix v. Cayetano consent decree compliance costs no later than twenty days before the convening of each regular session.
SECTION 3. The sum appropriated shall be expended by the office of the governor for the purposes of this Act.
SECTION 4. This Act shall take effect on July 1, 2001.
