A BILL FOR AN ACT

 

relating to public rights-of-way.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 265A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§265A- Duty to maintain public right-of-way on private roadways. Any county with a population of 500,000 or more shall prevent encroachments upon or obstructions of the public right-of-way on all roads, alleys, streets, ways, and lanes in the State, opened, laid out, or built by private parties and surrendered to the public use, notwithstanding that the roads, alleys, streets, ways, or lanes have not been taken over or accepted by the county."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2001-2002, and the same sum, or so much thereof as may be necessary for fiscal year 2002-2003, for prevention of encroachments upon or obstruction of public rights-of-way on private roadways.

SECTION 3. The sum appropriated shall be expended by the city and county of Honolulu for the purposes of this Act.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2001.
