A BILL FOR AN ACT
relating to fishing.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 188, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§188- Fishing in Nawiliwili harbor, Port Allen harbor, and Hanalei bay; restricted. (a) It is unlawful for any person to take marine life by means of any net, except for a hand net to land fish already caught by hook and line, in the waters of the "no netting zone" within Nawiliwili harbor. The "no netting zone" within Nawiliwili harbor shall be bounded by an imaginary straight line drawn from the northern end of the east pier and the southern end of the west pier.
(b) It is unlawful for any person to take marine life by means of any net, except for a hand net to land fish already caught by hook and line, in the waters of the "no netting zone" within Port Allen harbor. The "no netting zone" within Port Allen harbor shall be bounded by an imaginary straight line drawn from the tip of the main breakwater northward to the bend in the breakwater of the small boat harbor.
(c) It is unlawful for any person to take marine life by means of any net, except for a hand net to land fish already caught by hook and line and for nets used to conduct non-commercial fishing, in the waters of the "no netting zone" within Hanalei bay. The "no netting zone" within Hanalei bay shall be bounded by an imaginary straight line drawn from point "A" to point "B"."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval, and shall be repealed upon adoption of new administrative rules for Nawiliwili harbor, Port Allen harbor, and Hanalei bay by the department of land and natural resources.
