A BILL FOR AN ACT

 

relating to real estate salespersons and brokers.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 467, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§467- Mandatory disclosure relating to pets. Any person licensed under this chapter, with respect to any real property transaction, including a rental transaction, for which the licensee accepts compensation, shall disclose any provision relating to whether pets are permitted or prohibited on the property that is the subject of the transaction. Wilful failure to make this disclosure may result in disciplinary action against the licensee; provided that the failure to make a disclosure under this section shall not constitute grounds for license revocation under this chapter."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
