A BILL FOR AN ACT
RELATING TO CONDOMINIUMS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 514A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§
514A- Mediation. If an apartment owner or the board requests mediation of disputes involving section 514A-82, 514A-83, or 514A-84 through any entity involved in mediation approved by the real estate commission, the other party in the dispute shall be required to participate in mediation. If the dispute is not resolved in mediation, the entity conducting the mediation shall issue a report to the apartment owner and the board indicating the nature of the dispute, the facts presented by each side of the dispute in defense of their respective positions, and a copy of any documents which each side has submitted. If an owner or the board refuses to participate in mediation, the mediator shall provide a report to the other party to that effect, which may be used in any subsequent action."SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
