A BILL FOR AN ACT

 

RELATING TO TRANSPORTATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that there is a need for the reform of the state highways division of the department of transportation. A recent management audit of that division by the auditor found that the poorly managed division wasted taxpayers' resources. The purpose of this Act is therefore to require the director of transportation to implement needed financial and management standards and practices to provide for the efficient functioning of that division.

SECTION 2. The director of transportation shall:

(1) Require the highways division to develop statewide maintenance standards that include preventive maintenance practices. The division chief shall determine which portion of the maintenance budget is to be earmarked for preventive maintenance; and

(2) Ensure the efficient use of highway funds and improve the highway division's financial management by:

(A) Ensuring that supervisors review and properly approve all overtime requests. Staff shall not be allowed to incur overtime on days they are sick or on vacation;

(B) Ensuring that supervisors follow established procedures to ensure the fair and equitable distribution of overtime. Line staff and supervisors who fail to comply with established overtime practices shall be subject to progressive disciplinary action, up to and including dismissal; and

(C) Requiring that compensatory time under the Fair Labor Standards Act be restricted to the federal limit and that all staff exceeding this limit are immediately paid.

SECTION 3. The director of transportation shall report findings and progress made towards achieving the requirements of this Act, including any proposed legislation, to the legislature no later than twenty days before the convening of the regular session of 2002.

SECTION 4. This Act shall take effect upon its approval.
