RESOLUTION

WHEREAS, the Board of Land and Natural Resources is authorized to issue licenses granting any person the right to use government-owned water; and

WHEREAS, thirty per cent of state receipts from water licenses are supposed to be transferred to the native Hawaiian rehabilitation fund; and

WHEREAS, the moneys in the native Hawaiian rehabilitation fund, according to the state constitution, are supposed to be used for the general welfare of the native Hawaiian people; and

WHEREAS, it is necessary to determine what the revenue stream is from these water licenses to ascertain whether constitutional requirements are being met; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2001, the Senate concurring, that the Department of Land and Natural Resources is requested to report to the Legislature on the annual amount of state receipts derived from water licenses, and on the amount transferred to the Department of Hawaiian Home Land's native Hawaiian rehabilitation fund for fiscal year 2000-2001, pursuant to article XII, section 1 of the state constitution; and

BE IT FURTHER RESOLVED that the Department of Hawaiian Home Lands is requested to report to the Legislature on the amount of money received from the Department of Land and Natural Resources for water licenses, and the balance in the fund for fiscal year 2000-2001; and

BE IT FURTHER RESOLVED that these reports be transmitted to the Legislature no later than twenty days prior to the convening of the Regular Session of 2002; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources and to the Chairperson of the Hawaiian Homes Commission.
