HOUSE CONCURRENT

RESOLUTION

 

REQUESTING AN INVENTORY OF THE STATE SUGARCANE LANDS.

 

 

WHEREAS, the Constitution of the State of Hawaii requires that thirty per cent of the state receipts derived from the leasing of cultivated sugarcane lands shall be transferred to the native Hawaiian rehabilitation fund, as well as thirty per cent of the revenues whenever such lands are sold, developed, leased, utilized, transferred, set aside, or otherwise disposed of; and

WHEREAS, a complete inventory of the sugarcane lands, which are presently held for the State by the Department of Hawaiian Home Lands and the Department of Land and Natural Resources, needs to be done to ensure that the lands, and their concomitant revenues streams, are properly documented; and

WHEREAS, the funds from these lands are to be used to assist the general welfare of the native Hawaiians; and

WHEREAS, without an accurate inventory, it cannot be determined whether the State is meeting its constitutional obligations; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2001, the Senate concurring, that the Department of Hawaiian Home Lands and the Department of Land and Natural Resources are requested to do a complete inventory of the sugarcane lands under their respective jurisdictions, and identify and document their income streams for the purpose of ascertaining compliance with the State Constitution; and

BE IT FURTHER RESOLVED that the Departments present a copy of their respective inventories to the Legislature at least twenty days before the convening of the Regular Session of 2002; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Hawaiian Homes Commission and the Chairperson of the Board of Land and Natural Resources.
