A BILL FOR AN ACT
RELATING TO IDENTIFICATION DOCUMENTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 710, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§710- Sale or manufacture of deceptive identification document; penalties. (1) A person commits the offense of sale or manufacture of deceptive identification document if the person intentionally or knowingly manufactures, offers for sale, furnishes, offers to be furnished, transports, offers to be transported, or imports or offers to be imported into this State, a deceptive identification document.
(2) As used in this section, "deceptive identification document" means any document not issued by a governmental agency of this State or any political subdivision thereof, another state, or the federal government, which purports to be, or which might deceive a reasonable person into believing that it is, a document issued by such an agency, including a driver's license, identification card, birth certificate, passport, or social security card.
(3) Any person who violates subsection (1) shall be guilty of a class C felony.
(4) Any property used or intended for use in the commission of, attempt to commit, or conspiracy to commit an offense under this section, or which facilitated or assisted such activity, shall be forfeited subject to the requirements of chapter 712A."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
