A BILL FOR AN ACT
relating to PERIodic vehicle inspection.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that vehicle inspections are beneficial to safe driving in this State. However, annual inspections are costly, inconvenient, and of limited benefit to the driving public. Inspections every twenty-four months are just as beneficial as annual inspections but less costly and time consuming to the average driver. Many states across the United States only require vehicle inspections every other year.
The purpose of this Act is to amend section 286-26(b) and section 291C-202(c), Hawaii Revised Statutes, to require motor vehicle and moped safety inspections to be performed every twenty-four months rather than every twelve months.
SECTION 2. Section 286-26, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:
"(b) All other vehicles, including motorcycles, trailers, semitrailers, and pole trailers having a gross vehicle weight rating of [10,000] ten thousand pounds or less, and antique motor vehicles as defined in section 249-1, except those in subsections (c) and (d), shall be certified as provided in subsection (e) every [twelve] twenty-four months."
SECTION 2. Section 291C-202, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:
"(c) The director of transportation, by rules [and regulations, pursuant to] adopted in accordance with chapter 91, shall establish criteria and procedures for the [annual] safety inspection of every moped[.] every twenty-four months. Safety inspection criteria shall include the criteria established by the director of transportation under subsection (b)."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
