A BILL FOR AN ACT

 

RELATING TO THE CHILD SUPPORT ENFORCEMENT AGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 576D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§576D- Application. The agency shall prepare an application form under Title IV-D for a custodial parent seeking child support. The application shall be completed and returned to the agency no later than the date the order for custody is entered. If the application is not completed and returned by that date, the court may make findings in its order as to the party, custodial parent, noncustodial parent, or both, who is responsible for the delay and may fashion an appropriate remedy for the delay. If the court finds that the noncustodial parent has avoided providing the information necessary to complete the form, the court may award monetary sanctions against the noncustodial parent in favor of the custodial parent."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
