A BILL FOR AN ACT

 

RELATING TO PURE HAWAIIAN DRINKING WATER.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that there is conflicting evidence regarding whether adding fluoride to an individual's diet significantly reduces the incidence of tooth decay or dental caries. In addition, there is evidence that adding fluoride to the diet poses risks including dental fluorosis in children, rare bone cancer in young males, and brittle bones in the elderly. Causing all citizens to ingest any such chemical without allowing them the opportunity to choose is unethical and, in light of present controversy, irresponsible. Further, the legislature finds that administering medication or supplements via the public water supply is contrary to the public good and an inefficient use of money.

SECTION 2. Chapter 340E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§340E- Use of fluoride banned. No supplier of water shall introduce a fluoride or a fluorine-containing substance into the public water system. Any violation of this section shall be penalized under section 340E-8."

SECTION 3. Section 340E-8, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) Any person who violates section 340E-7 or 340E-   shall be administratively or civilly penalized not more than $25,000 per day for each violation."

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
