A BILL FOR AN ACT

 

PROPOSING AN amendment to ARTICLE ii, SECTION 2, OF THE STATE CONSTITUTION TO REPEAL the disqualification of mentally incompetent voters.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to propose an amendment to article II, section 2, of the Constitution of the State of Hawaii to allow mentally incompetent individuals to vote.

SECTION 2. Article II, section 2, of the Constitution of the State of Hawaii is amended to read as follows:

"DISQUALIFICATION

Section 2. [No person who is non compos mentis shall be qualified to vote.] No person convicted of a felony shall be qualified to vote except upon the person's final discharge or earlier as provided by law. "

SECTION 3. The question to be printed on the ballot shall be as follows:

"Shall the Hawaii State Constitution be amended to allow mentally incompetent individuals to vote?"

SECTION 4. Constitutional material to be repealed is bracketed and stricken.

SECTION 5. This Act shall take effect in compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
