A BILL FOR AN ACT
RELATING TO HAWAIIANS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 201, Hawaii Homes Commission Act, 1920, is amended by amending the definition of "native Hawaiian" to read as follows:
""Native Hawaiian" means any descendant of not less than one-half part of the blood of the races inhabiting the Hawaiian Islands previous to 1778[.], and the descendants of any person who was a naturalized citizen of the Kingdom of Hawaii."
SECTION 2. Section 10-2, Hawaii Revised Statutes, is amended by amending the definition of "Hawaiian" and "Native Hawaiian" to read as follows:
""Hawaiian" means any descendant of the aboriginal peoples inhabiting the Hawaiian Islands which exercised sovereignty and subsisted in the Hawaiian Islands in 1778, and which peoples thereafter have continued to reside in Hawaii[.], and the descendants of any person who was a naturalized citizen of the Kingdom of Hawaii.
"Native Hawaiian" means any descendant of not less than one-half part of [the]:
(1) The races inhabiting the Hawaiian Islands previous to 1778, as defined by the Hawaiian Homes Commission Act, 1920, as amended; [provided that the term identically refers to the]
(2) The descendants of such blood quantum of such aboriginal peoples which exercised sovereignty and subsisted in the Hawaiian Islands in 1778 and which peoples thereafter continued to reside in Hawaii[.]; and
(3) The descendants of any person who was a naturalized citizen of the Kingdom of Hawaii."
SECTION 3. Section 11-1, Hawaii Revised Statutes, is amended by amending the definition of "Hawaiian" to read:
""Hawaiian", any descendant of the aboriginal peoples inhabiting the Hawaiian Islands which exercised sovereignty and subsisted in the Hawaiian Islands in 1778, and which peoples thereafter have continued to reside in Hawaii[.], and the descendants of any person who was a naturalized citizen of the Kingdom of Hawaii."
SECTION 4. Section 188-22.6, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:
"(c) For the purposes of this section:
(1) "Native Hawaiian" means any descendant of the races inhabiting the Hawaiian Islands prior to 1778[;] and any descendant of any person who was a naturalized citizen of the Kingdom of Hawaii; and
(2) "Subsistence" means the customary and traditional native Hawaiian uses of renewable ocean resources for direct personal or family consumption or sharing."
SECTION 5. Statutory and Hawaiian Homes Commission Act material to be repealed is bracketed and stricken.
SECTION 6. This Act shall take effect upon its approval, provided that section 1 shall take effect upon the approval of Congress.
