A BILL FOR AN ACT

 

relating to transportation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Toll roads; feasibility study; report. (a) The department of transportation shall conduct a study of the feasibility of authorizing toll roads for motor vehicle traffic in each county. The study shall include the following:

(1) The most appropriate areas for the placement of a toll road in each county;

(2) Whether the placement of particular toll roads will require the exercise of the power of eminent domain by the State or county;

(3) Whether the toll roads should be funded, acquired, owned, designed, constructed, maintained, and controlled, either in whole or in part, by the State, the counties, or private developers;

(4) The approximate costs for each suggested toll road, including costs for:

(A) The acquisition of any land necessary for the construction of the toll road and any necessary maintenance facilities;

(B) The construction of the toll road; and

(C) The operation of the toll road system; and

(5) A review of all applicable federal, state, and county laws that must be complied with relating to the construction, operation, and maintenance of toll roads, whether those roads are controlled by the State, the counties, or private developers.

(b) The department shall report its findings and recommendations, including any proposed implementing legislation, to the legislature no later than twenty days before the convening of the regular session of 2002.

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $1 or so much thereof as may be necessary for fiscal year 2001-2002 to conduct the feasibility study of authorizing toll roads for motor vehicle traffic in each county.

The sum appropriated shall be expended by the department of transportation for the purposes of this Act.

SECTION 3. This Act shall take effect upon its approval; provided that section 2 shall take effect on July 1, 2001.
