A BILL FOR AN ACT
RELATING TO MEAL BREAKS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 378-10, Hawaii Revised Statutes, is amended to read as follows:
"[[]§378-10[] Breastfeeding.] Meal breaks; breastfeeding. (a) No employee shall be required to work more than five hours continuously without an interval of at least thirty consecutive minutes for a meal period or other break period, unless a collective bargaining agreement otherwise contains express provisions for employee meal breaks.
(b) No employer shall prohibit an employee from expressing breastmilk during any meal period or other break period required [by law to be provided by the employer or required] under this section or by collective bargaining agreement."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
