         Establishes a False Claims Act allowing citizens
         to sue as qui tam plaintiffs for false claims

         Requires all newly constructed school buildings,
         and all existing school buildings, undergoing re-
         roofing, to include thermal control systems with
         a minimum heat transfer resistance value of R-19,
         or its equivalent, in conformance with the
         provisions of the Hawaii Model Energy Code
         regarding roof heat gain, during their
         construction or re-roofing. Blank appropriation.

         Lowers candidate funding available from public
         funds for office of governor, lt. gov, or mayor
         from 20% to 10%, and for state senator, state
         representative, county council and prosecuting
         attorney from 30% to 15% of total limit
         established. Adds candidate's web page and e-mail
         address to the name and address on organizational
         report of a candidate's committee. Removes ballot
         issue from requirement of organizational report.
         Increases from 5 to 10 days after filing for
         office, deadline for filing an organizational
         report. Requires candidates who withdraw or cease
         to be candidates to return private contributions
         to the donors within 4 years, and in the event of
         death, requires residual contributions to escheat
         to the Hawaii election campaign fund. (SD1)

         Defines independent bill reviewer (IBR) for
         insurance purposes; requires licensing of IBRs;
         levies an IBR license fee of $80 and $60 a year
         for services provided by DCCA. Prohibits IBRs
         from being paid on a contingency fee basis.
         Establishes and appropriates funds to regulate
         independent bill reviewers. (SD1) 

2218     RELATING TO NEW CENTURY CHARTER SCHOOLS             EDN,LMG,LAB/FIN
         Provides legal protection for new century charter
         school boards. Allows groups of teachers at a
         school to form a charter school. Requires the
         auditor to consider the advice of the
         superintendent and local school boards in setting
         the allocation for new century charter schools.
         Appropriates funds for the establishment of
         additional new century charter schools, including
         the hiring of additional school personnel. (SD1)

         Exempts the acquisition of school facilities by
         leases from the law relating to the management of

         Allows biotechnology companies to sell their
         unused net operating loss carryover and unused

         Clarifies functions of medicaid fraud unit of the
         attorney general to enforce Medicaid fraud and

         recovery fund to provide funds for abuse and

         Creates a cigarette tax stamping licensing system
         for the excise tax on cigarettes to be imposed
         and collected through the use of stamps purchased
         by licensed wholesalers and dealers, and affixed
         to cigarette packages. Includes provisions for
         civil and criminal penalties, and for forfeitures
         of cigarettes, to be enforced by the attorney
         general. Requires the Director of Taxation to
         submit findings and recommendations to the
         legislature for the 2006 Session on effectiveness
         of Act. (SD2) 

2496     RELATING TO HAWAII TOBACCO SETTLEMENT MONEYS        HLT,FIN
         Allocates      % of tobacco settlement moneys to
         emergency and budget reserve fund and      % to

         benefits paid when the insured has recovered
         damages on the third party claim by judgment or

2571     RELATING TO SCHOOL-BASED BUDGETING                  EDN,FIN
         Amends chapter 302A, HRS, to facilitate
         implementation of school-based budgeting, by
         requiring the DOE to submit to the individual
         schools and the legislature, by opening day of
         each regular session, a report on its proposed
         school-by-school budget allocation. Gives each
         school maximum flexibility in expending its
         allocated budget. (SD1) 

2572     RELATING TO THE UNIVERSITY OF HAWAII FACILITIES
         USE REVOLVING FUND                                  HED,FIN
         Authorizes real property revenues of the
         University of Hawaii to be deposited into a
         university revolving fund.

         Authorizes the University of Hawaii community
         colleges to deposit their special fund revenues

         Establishes the University of Hawaii facilities

         Establishes a fair market value standard (FMVS)
         for appraising the leased fee interest of condo
         and co-op housing corporations for leases that do

         on or after effective date of this Act; allows
         FMVS if lessor and lessee agree for leases prior

         Creates the special needs housing special fund to
         be used to provide supportive housing for persons
         with mental illness and substance abuse
         addictions. Authorizes the issuance of general
         obligation bonds to be deposited into the special

2584     RELATING TO THE HAWAII COMMUNITY DEVELOPMENT

         Transfers the development responsibilities of the
         Barbers Point Naval Air Station Redevelopment
         Commission to the HCDA. Designates former Barbers
         Point Naval Air Station area as an enterprise

         Requires employer-requested medical examinations
         for workers' compensation cases to be performed
         by a physician selected by mutual agreement of
         the parties, or if no agreement, by a physician

         Provides and limits optional exemptions from the
         unemployment insurance law for business owners
