Sir:

     Your Committee on Labor and Environment, to which was
referred S.B. No. 45 entitled: 

     "A BILL FOR AN ACT RELATING TO VACANCIES,"

begs leave to report as follows:

     The purpose of this measure is to create a pool of vacant
positions; abolish one-half of the vacant positions; and grant
the authority to reallocate the remaining positions to the
Governor or Chief Justice, as appropriate.  The measure also
prohibits the creation of new positions.

     Testimony supporting the intent of this measure was received
from the Department of Budget and Finance.  Testimony opposing
this measure was received from the Judiciary, the Department of
Land and Natural Resources, and the Department of Education.

     Your Committee finds that one means of addressing the
State's fiscal crisis is to reduce the size of state government.
This measure merits further discussion as a potential tool to
effectuate this desired goal.

     As affirmed by the record of votes of the members of your
Committee on Labor and Environment that is attached to this
report, your Committee is in accord with the intent and purpose
of S.B. No. 45 and recommends that it pass Second Reading and be
referred to the Committee on Ways and Means.
