Sir:

     Your Committees on Labor and Public Employment and Finance,
to which was referred S.B. No. 3002, S.D. 2, entitled: 

     "A BILL FOR AN ACT RELATING TO THE EMPLOYEES' RETIREMENT
     SYSTEM,"

beg leave to report as follows:

     The purpose of this bill is to allow a surviving spouse or
reciprocal beneficiary of a deceased member of the Employees'
Retirement System who was employed as a police officer, fire
fighter, deputy sheriff, or public safety officer to continue to
receive pension and other retirement benefits upon remarriage or
entry into a new reciprocal relationship.

     The Concerns of Police Survivors, Hawaii Chapter, and the
Maui County Police Department testified in support of this bill.
The Hawaii Government Employees Association testified in support
of the intent of this bill with amendments.  The Department of
Budget and Finance and the Employees' Retirement System commented
on this bill.

     Your Committees have amended this bill by:

     (1)  Ensuring that only the beneficiaries of members who
          were killed in the line of duty will continue to
          receive benefits upon remarriage, marriage, or entry
          into a new reciprocal relationship;

     (2)  Including the situation where a reciprocal relationship
          beneficiary enters into a marriage and maintains
          benefits;

     (3)  Changing the effective date of this bill to July 1,
          2010; and

     (4)  Making technical, nonsubstantive changes for clarity
          and style.

     As affirmed by the records of votes of the members of your
Committees on Labor and Public Employment and Finance that are
attached to this report, your Committees are in accord with the
intent and purpose of S.B. No. 3002, S.D. 2, as amended herein,
and recommend that it pass Second Reading in the form attached
hereto as S.B. No. 3002, S.D. 2, H.D. 1, and be placed on the
calendar for Third Reading.
