Sir:

     Your Committee on Transportation, to which was referred S.B.
No. 2955 entitled: 

     "A BILL FOR AN ACT RELATING TO HIGHWAY SAFETY,"

begs leave to report as follows:

     The purpose of this bill, as received by your Committee, is
to give the Director of Transportation the authority to adopt
rules dealing with road use restrictions, and to increase
penalties for violations governing the use of traffic control
devices at work sites.

     Your Committee finds that the Director of Transportation
does not have the authority to restrict road use to prevent the
transport of hazardous chemicals and materials through unsuitable
areas, such as Wilson Tunnel.  Your Committee further finds that
any person, engaged in construction, maintenance, surveying or
other work on or adjacent to a public street or highway where
traffic regulations are imposed, who violates the rules governing
the use of traffic control devices at such work sites is subject
to a fine of not more than $1,000.

     This bill proposes that the Director of Transportation be
given the authority to adopt rules pertaining to road use
restrictions, and to increase fines for violations of rules
governing the use of traffic control devices to not more than
$2,000.

     Testimonies in support of this measure were received from
the Department of Transportation; and the City and County of
Honolulu, Department of the Prosecuting Attorney and the Police
Department.

     Your Committee observes that the provisions of S.B. 2955 are
identical with those which passed the House as H.B. 2614.

     As affirmed by the record of votes of the members of your
Committee on Transportation that is attached to this report, your
Committee is in accord with the intent and purpose of S.B. No.
2955 and recommends that it pass Second Reading and be referred
to the Committee on Judiciary and Hawaiian Affairs.
