                                   RE: S.B. No. 2878
                                        S.D. 1

Honorable Norman Mizuguchi
President of the Senate
Twentieth State Legislature
Regular Session of 2000
State of Hawaii

Sir:

Your Committee on Health and Human Services, to which was
referred S.B. No. 2878 entitled:

"A BILL FOR AN ACT MAKING AN EMERGENCY APPROPRIATION FOR THE
     ADULT MENTAL HEALTH DIVISION,"

begs leave to report as follows:

The purpose of this measure is to make an emergency
appropriation for the adult mental health division.

Your Committee received testimony in support of this measure
from the Department of Health (DOH), Attorney General, Board of
Health, State Mental Health Planning and Advisory Council, HGEA-
AFSCME, Mental Health Association in Hawaii, NAMI Oahu, and a
private individual.

This measure is to provide funds to implement additional
services and activities at the State Hospital to reach compliance
with the requirements of the settlement agreement and subsequent
orders in United States v. State of Hawaii, Civil Number 91-00137
(DAE). In 1991, the State and the federal government entered
into a settlement agreement, but the case remains open pending
compliance by the State to the terms of the settlement agreement.

Your Committee has amended this measure on the advice of the
DOH by inserting an appropriation amount and making technical,
nonsubstantive changes to reflect preferred drafting style,
clarity, and consistency.
