Sir:

     Your Committee on Transportation, to which was referred S.B.
No. 2635 entitled: 

     "A BILL FOR AN ACT RELATING TO HIGHWAYS,"

begs leave to report as follows:

     The purpose of this bill, as received by your Committee, is
to strengthen restrictions on highway vending activities, and to
expedite the resolution of violations.

     Your Committee finds that violators of the highway vending
law may be cited by police only after a hazardous condition is
actually created, rather than as a preventive measure to
forestall potential traffic hazards.  Your Committee further
finds that violations are now classified as misdemeanors,
entitling the accused to jury trials, thus delaying action on
such violations.

     This bill proposes to extend the prohibition against vending
from on and along highways to include the risk of creating a
hazardous condition or public nuisance.  The proposed measure
also reduces offenses from misdemeanors to petty misdemeanors,
thus expediting the resolutions of cases against the accused.

     Testimonies in support of this measure were received from
the Department of Transportation; City and County of Honolulu,
Department of the Prosecuting Attorney and the Police Department.

     As affirmed by the record of votes of the members of your
Committee on Transportation that is attached to this report, your
Committee is in accord with the intent and purpose of S.B. No.
2635 and recommends that it pass Second Reading and be referred
to the Committee on Judiciary and Hawaiian Affairs.
