Sir:

     Your Committee on Finance, to which was referred S.B. No.
2115, S.D. 1, H.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO FALSE CLAIMS,"

begs leave to report as follows:

     The purpose of this bill is to establish a Qui Tam Actions
or Recovery of False Claims Act, modeled after the Federal False
Claims Act, to allow persons with evidence of fraud against state
programs or contracts to sue the wrongdoer on behalf of the
State.

     The Department of the Attorney General and the Consumer
Lawyers of Hawaii testified in support of this bill.

     Your Committee has amended this bill by inserting language
that will bar claims from being brought under this Act if a civil
or criminal investigation is already being conducted by the
State.

     As affirmed by the record of votes of the members of your
Committee on Finance that is attached to this report, your
Committee is in accord with the intent and purpose of S.B. No.
2115, S.D. 1, H.D. 1, as amended herein, and recommends that it
pass Third Reading in the form attached hereto as S.B. No. 2115,
S.D. 1, H.D. 2.
