Sir:

     Your Committee on Water, Land, and Hawaiian Affairs, to
which was referred S.B. No. 2111 entitled: 

     "A BILL FOR AN ACT RELATING TO THE OFFICE OF HAWAIIAN
     AFFAIRS SALARY COMMISSION,"

begs leave to report as follows:

     The purpose of this measure is to clarify that gubernatorial
nominees to the Office of Hawaiian Affairs Salary Commission are
subject to the advice and consent of the Senate.

     Your Committee received testimony in support of the measure
from the Office of Hawaiian Affairs.

     Testimony in opposition to the measure was received from the
Hawaiian Political Action Council of Hawaii.

     Your Committee finds that under existing law, there is a
perceived conflict as to whether gubernatorial nominees to the
Office of Hawaiian Affairs Salary Commission are subject to the
advice and consent of the Senate.  Although Section 10-9.5,
Hawaii Revised Statutes, is silent on the issue of having the
Senate advise and consent to these nominations, Section 26-34,
Hawaii Revised Statutes, does state that "...members of each
board and commission established by law shall be nominated and,
by and with the advice and consent of the senate, appointed by
the governor."  Therefore, your Committee believes that in order
to clarify the Senate's authority in this matter, the amendment
contained in the measure is necessary.

     As affirmed by the record of votes of the members of your
Committee on Water, Land, and Hawaiian Affairs that is attached
to this report, your Committee is in accord with the intent and
purpose of S.B. No. 2111 and recommends that it pass Second
Reading and be referred to the Committee on Ways and Means.
