Sir:

     Your Committee on Ways and Means, to which was referred S.B.
No. 2110, S.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO HAWAIIAN HOME LANDS TRUST
     INDIVIDUAL CLAIMS,"

begs leave to report as follows:

     The purpose of this bill is to extend the term of the
Hawaiian home lands trust individual claims review panel to 2002.

     The bill also establishes a Hawaiian home lands trust
individual claims compensation panel within the Legislative
Reference Bureau.

     The Hawaiian home lands trust individual claims review panel
was established by the Legislature in 1991.  Its purpose was to
establish a process under which individual trust beneficiaries
could resolve claims for actual damages resulting from a breach
of trust.  Your Committee finds that the panel's work is worthy
but not yet complete, and that this bill would extend the time
frame of the panel until 2002 to allow it to complete its task.

     The bill also establishes a Hawaiian home lands trust
individual claims compensation commission to evaluate funding
mechanisms to compensate successful claimants.  Your Committee
finds that such a compensation commission is an appropriate next
step, but questions its placement for administrative purposes in

the Legislative Reference Bureau.  There are no funds to support
such a commission, so commission members, especially those who
reside on the neighbor islands, will have to pay their own travel
and other business expenses.  Additionally, the commission will
have no office space, and will not even have conference or
meeting facilities if the Legislature is in session or the
conference rooms in the Capitol are otherwise in use.  Your
Committee finds that these are troublesome issues and has thus
amended this bill by extending its effective date to 2010.

     As affirmed by the record of votes of the members of your
Committee on Ways and Means that is attached to this report, your
Committee is in accord with the intent and purpose of S.B. No.
2110, S.D. 1, as amended herein, and recommends that it pass
Third Reading in the form attached hereto as S.B. No. 2110,
S.D. 2.
