Sir:

     Your Committee on Consumer Protection and Commerce, to which
was referred S.B. No. 20, S.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO REAL ESTATE BROKERS AND
     SALESPERSONS,"

begs leave to report as follows:

     The purpose of this bill is to support the provision of
continuing education in the real estate industry by:

     (1)  Combining existing real estate continuing education
          statutes into a single section;

     (2)  Providing that real estate brokers are responsible for
          maintaining the expertise of associated real estate
          licensees through continuing education; and

     (3)  Mandating that continuing education be based on current
          information, law, and rules.

     Your Committee received testimony from the Department of
Commerce and Consumer Affairs strongly supporting this bill.  The
Hawaii Association of Realtors (HAR) also submitted testimony in
support of this measure.

     Your Committee notes that this bill is similar to H.B. No.
791 H.D. 1, which passed out of your Committee earlier this
session.  The bills differ substantively in that the Senate bill

requires that HAR initiate a work study group and submit its
recommendations to the legislature, whereas the House bill
provides that DCCA shall initiate the study in consultation with
the HAR, and subsequently report its recommendations.  Your
Committee has amended this bill to facilitate further discussion,
by replacing its contents with those of H.B. No. 791 H.D. 1, and
has also made a technical amendment to conform the bill to
standard drafting conventions.

     As affirmed by the record of votes of the members of your
Committee on Consumer Protection and Commerce that is attached to
this report, your Committee is in accord with the intent and
purpose of S.B. No. 20, S.D. 1, as amended herein, and recommends
that it pass Second Reading in the form attached hereto as S.B.
No. 20, S.D. 1, H.D. 1, and be referred to the Committee on
Finance.
