Sir:

     Your Committee on Judiciary, to which was referred S.B. No.
13 entitled: 

     "A BILL FOR AN ACT RELATING TO PROCESS SERVERS,"

begs leave to report as follows:

     The purpose of this bill is to allow fees and mileage for
process servers to be included in court costs.

     Your Committee received favorable testimony from Hawaii
Provider's Network, Inc.; Credit Associates of Maui, Ltd.; Maui
Collections Service; State Wide Collections; and the Hawaiian
Collectors Association.

     Presently, legal service of process is provided by the
sheriff's office and private process servers.  The fees and
mileage for process servers, however, are not included in court
costs.  Unlike the sheriff's office, fees and mileage is an
expense to the process server.  This bill levels the playing
field by treating fees and mileage costs as court costs for both
the sheriff's office and private process servers.

     As affirmed by the record of votes of the members of your
Committee on Judiciary that is attached to this report, your
Committee is in accord with the intent and purpose of S.B. No. 13
and recommends that it pass Second Reading and be placed on the
calendar for Third Reading.
