Sir:

     Your Committee on Education, to which was referred S.B. No.
1275, S.D. 1, H.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO CIVIL SERVICE EXEMPTIONS,"

begs leave to report as follows:

     The purpose of this bill is to expand the civil service
exemption to Department of Education (DOE) employees who
supervise students during meal periods in the distribution,
collection, and counting of meal tickets.

     The DOE submitted testimony in support of and to clarify
this measure.

     Your Committee finds that this bill will provide flexibility
to the DOE in hiring persons to provide assistance during periods
in order to comply with the United States Department of
Agriculture's AccuClaim Regulation which requires that there be:

     (1)  No overt identification of students receiving free or
          reduced-price meals; and 

     (2)  An accurate accountability of all meals claimed for
          federal reimbursement.

     Based on the recommendations of the DOE, your Committee has
amended the bill to clarify that there are two positions that
have separate and distinct functions.

     As affirmed by the record of votes of the members of your
Committee on Education that is attached to this report, your
Committee is in accord with the intent and purpose of S.B. No.
1275, S.D. 1, H.D. 1, as amended herein, and recommends that it
be referred to the Committee on Finance in the form attached
hereto as S.B. No. 1275, S.D. 1, H.D. 2.
