Sir:

     Your Committee on Human Services and Housing, to which was
referred S.B. No. 1058, S.D. 2, entitled: 

     "A BILL FOR AN ACT RELATING TO RECOVERY OF MEDICAL
     PAYMENTS,"

begs leave to report as follows:

     The purpose of this bill is to allow the Department of Human
Services (DHS) to subrogate against a third-party recovery on any
claim brought by an injured person who receives medical
assistance.

     DHS submitted testimony in support of this measure.

     Your Committee has amended this measure by deleting its
substance and inserting similar language reflected in H.B. No.
1125, H.D. 2.  As amended, the purpose of this bill is to clarify
and standardize provisions relating to the recovery of medical
assistance payments by DHS in third-party liability situations.

     As affirmed by the record of votes of the members of your
Committee on Human Services and Housing that is attached to this
report, your Committee is in accord with the intent and purpose
of S.B. No. 1058, S.D. 2, as amended herein, and recommends that
it pass Second Reading in the form attached hereto as S.B. No.
