Sir:

     Your Committee on Legislative Management, to which was
referred H.B. No. 2636 entitled: 

     "A BILL FOR AN ACT RELATING TO CAMPAIGN ACTIVITIES OF STATE
     LEGISLATORS AND STATE EMPLOYEES,"

begs leave to report as follows:

     The purpose of this bill is to prohibit legislators and
state employees from using state resources or their official
positions in any political campaign. 

     The Hawaii State Ethics Commission, Common Cause Hawaii, and
The League of Women Voters of Hawaii submitted testimony in
support of the measure.

     Although the State Ethics Code has been interpreted to
prohibit the use of state resources in a political campaign,
there is no law specifically prohibiting legislators and state
employees from using state time, equipment, and facilities for
any political campaign.  Public confidence in the integrity of
the political process mandates that the law specifically
prohibits legislators and state employees from using state
resources and their official positions in any political campaign.

     As affirmed by the record of votes of the members of your
Committee on Legislative Management that is attached to this
report, your Committee is in accord with the intent and purpose
of H.B. No. 2636 and recommends that it pass Second Reading and
be referred to the Committee on Judiciary and Hawaiian Affairs.
