Honorable Calvin K.Y. Say
Speaker, House of Representatives
Twentieth State Legislature

Sir:

     Your Committee on Consumer Protection and Commerce, to which
was referred H.B. No. 2425 entitled:

     "A BILL FOR AN ACT RELATING TO CONDOMINIUM PROPERTY
     REGIMES,"

begs leave to report as follows:

     The purpose of this measure is to amend Chapter 514A, Hawaii
Revised Statutes, by:

          property regimes (CPRs) are subject to county zoning
          and development ordinances and rules;

     (2) Clarifying county authority to adopt supplemental rules
          to ensure conformance of CPRs with county ordinances;
          and

     (3) Assuring that a declaration asserting conformance of
          CPR projects with county ordinances is filed either at
          recordation or with a final report.

     Testimony in support of this measure was submitted by the
Department of Business Economic Development & Tourism, the
Planning Department of the County of Hawaii, Hawaii's Thousand

     Your Committee has made the following amendments to this
measure:

     (1) Removed the word "intent" throughout the bill and
          replaced with "purposes" to clarify that the purposes
          of this bill correspond to the purpose statement of the
          applicable county ordinance;

     (2) Changed reference of declaration "under penalty of law"
          to declaration "subject to the penalties set forth in
          section 514A-49(b)";

     (3) Modified the enactment provision so that this measure
          has prospective effect and operation only; and

     (4) Made technical nonsubstantive amendments for purposes
          of clarity, consistency, and style.

     As affirmed by the record of votes of the members of your
Committee on Consumer Protection and Commerce that is attached to

purpose of H.B. No. 2425, as amended herein, and recommends that
it pass Second Reading in the form attached hereto as H.B. No.
2425, H.D. 1, and be placed on the calendar for Third Reading.

                                   Respectfully submitted on
                                   behalf of the members of the
                                   Committee on Consumer
                                   Protection and Commerce,
