                                 RE: H.B. No. 2388
                                     H.D. 2

Honorable Calvin K.Y. Say
Speaker, House of Representatives
Twentieth State Legislature
Regular Session of 2000
State of Hawaii

Sir:

Your Committee on Judiciary and Hawaiian Affairs, to which
was referred H.B. No. 2388, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO EDUCATION,"

begs leave to report as follows:

The purpose of this bill as received is to:

     (1) Extend the Department of Education's (DOE) zero
tolerance policy to include Department supervised
          activities on or off school property;

     (2) Prohibit the possession, sale, or use of various
          dangerous items; and

     (3) Prohibit the possession, sale, consumption, or use of
          intoxicating liquor or illicit drugs.

Testimony in support of this measure was received from the
Department of the Attorney General, the DOE, and the Hawaii State
Teachers Association.

Your Committee finds that the possession, sale, or use of
dangerous items, and the possession, sale, consumption, or use of
intoxicating liquor or illicit drugs by students while attending
school, create unsafe atmospheres for students and teachers at
Hawaii's public schools.

                                 STAND. COM. REP. NO. 717-00
                                 Page 2

Your Committee has amended this bill by:

     (1) Deleting the proposed language extending the
prohibitions of section 302A-1134.5, Hawaii Revised
Statutes, to periods during DOE supervised activities
on or off school property; and

     (2) Deleting the broad language extending the same
prohibitions to activities during school hours or on
          school premises.

As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 2388, H.D. 1, as amended herein, and
recommends that it pass Third Reading in the form attached hereto
as H.B. No. 2388, H.D. 2.

                                   Respectfully submitted on
behalf of the members of the
                                   Committee on Judiciary &
                                   Hawaiian Affairs,

                                   ______________________________
                                   ERIC G. HAMAKAWA, Chair
