Sir:

     Your Committee on Commerce and Consumer Protection, to which
was referred H.B. No. 2216 entitled: 

     "A BILL FOR AN ACT RELATING TO UNINSURED MOTOR VEHICLES,"

begs leave to report as follows:

     The purpose of this measure is to delete the requirement in
the definition of uninsured motor vehicle that the claimant
notify the claimant's insurer that the claimant has a legal
action arising out of an accident with an unidentified motor
vehicle.

     Your Committee received testimony from the State Insurance
Commissioner and Consumer Lawyers of Hawaii.

     Your Committee finds that the current law requiring
notification of the claimant's insurer within thirty days after
an accident with an unidentified motor vehicle is inconsistent
with the two-year statute of limitations under section
431:10C-315, Hawaii Revised Statutes.  Your Committee believes
that remedying the inconsistency is in the best interest of law
abiding consumers.

     As affirmed by the record of votes of the members of your
Committee on Commerce and Consumer Protection that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 2216 and recommends that it pass Second
Reading and be placed on the calendar for Third Reading.
