Sir:

     Your Committee on Consumer Protection and Commerce, to which
was referred H.B. No. 2148 entitled: 

     "A BILL FOR AN ACT RELATING TO MOTORCYCLE AND MOTOR SCOOTER
     INSURANCE,"

begs leave to report as follows:

     The purpose of this measure is to establish a "good faith"
defense within the Insurance Code for persons charged with an
insurance violation in connection with a motorcycle or
motorscooter.

     Your Committee finds that motorcycle and motor scooter
operators should have the same protection and opportunity to
exercise this defense as do motor vehicle operators. 

     Testimony was received in support of this measure from the
Department of Commerce and Consumer Affairs and Consumer Lawyers
of Hawaii.

     As affirmed by the record of votes of the members of your
Committee on Consumer Protection and Commerce that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 2148 and recommends that it pass Second
Reading and be placed on the calendar for Third Reading.
