Sir:

     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred H.B. No. 2090 entitled: 

     "A BILL FOR AN ACT RELATING TO IMPAIRED DRIVERS,"

begs leave to report as follows:

     The purpose of this bill as received by your Committee, is
to impose the same requirements on, and offer the same
protections to, health care providers who treat drug-impaired
patients involved in motor vehicle collisions, as exist for those
who treat patients with alcohol in their blood.

     Testimony in support of this measure was received from the
State Department of Transportation, City and County of Honolulu
Police Department, and Mothers Against Drunk Driving.  Testimony
in opposition to this measure was received from the Office of the
Public Defender, and Hawaii Medical Association.

     Your Committee finds that placing reporting requirements
upon health care providers of patients involved in motor vehicle
collisions whose blood or urine contain drugs that impair a
person's ability to operate a vehicle, will equalize enforcement
for the offenses of driving under the influence of alcohol and
driving under the influence of drugs.

     Your Committee has amended the bill by deleting the
reference to "drugs that are capable of impairing" and replacing
it with the phrase "drugs that impair", and by making technical,
non-substantive changes for purposes of clarity and style.

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 2090, as amended herein, and recommends that
it pass Third Reading in the form attached hereto as H.B. No.
2090, H.D. 1.
