Sir:

     Your Committee on Education, to which was referred H.B. No.
1986 entitled: 

     "A BILL FOR AN ACT RELATING TO ASSAULT IN THE SECOND
     DEGREE,"

begs leave to report as follows:

     The purpose of this bill is to expand the scope of assault
in the second degree to include within the definition of
"educational worker" any person who is employed by the Department
of Education (DOE) on a contractual basis for a school program,
activity, or function that is established, sanctioned, or
approved by the DOE.

     The DOE testified in support of the measure.

     Your Committee believes that this bill will provide the same
level of protection for all educational workers in Hawaii.

     As affirmed by the record of votes of the members of your
Committee on Education that is attached to this report, your
Committee is in accord with the intent and purpose of H.B. No.
1986 and recommends that it pass Second Reading and be referred
to the Committee on Judiciary and Hawaiian Affairs.
