                    SENATE  CONCURRENT
                        RESOLUTION
  REQUESTING THE AUDITOR TO ANALYZE THE IMPACT OF INCREASING THE
    DEPARTMENT OF TRANSPORTATION'S AUTHORITY AND JURISDICTION
    OVER HARBORS.



 1        WHEREAS, because Hawaii's planning and development
 2   functions are cumbersome and inflexible, the Department of
 3   Transportation has encountered inefficiencies in developing
 4   lands and facilities under its jurisdiction; and
 5   
 6        WHEREAS, the economic well-being of the State depends in
 7   part on the efficient use of all of its resources; and
 8   
 9        WHEREAS, fuller utilization of state resources will
10   enhance and complement efforts to revitalize Hawaii's economy;
11   and
12   
13        WHEREAS, coordinated planning and development of
14   Department of Transportation lands and facilities can be
15   carried out more effectively by a single department having
16   overall consolidated jurisdiction over planning and
17   development; and
18   
19        WHEREAS, granting the Department of Transportation broader
20   authority over harbor lands and expanding its power and duties
21   to include authorizing nonmaritime ancillary or supportive uses
22   of harbor lands that have a public benefit and generate a fair
23   return to developers for public improvements of harbor
24   facilities will speed up the process of leasing its lands and
25   increase Harbors Division revenues necessary to support public
26   facilities; now, therefore,
27   
28        BE IT RESOLVED by the Senate of the Twentieth Legislature
29   of the State of Hawaii, Regular Session of 2000, the House of
30   Representatives concurring, that the Auditor is requested to
31   analyze and determine the impact of providing the Harbors
32   Division of the Department of Transportation with the authority
33   to dispose of leases, easements, revocable permits, and
34   construction rights of entries to harbor lands to allow the
35   efficient planning and development of harbor lands for maritime
36   and nonmaritime ancillary or supportive uses on back-up lands;

 1        BE IT FURTHER RESOLVED that the Auditor is requested to
 2   review harbors, including those commercial harbors, small boat
 3   harbors, and lands set aside to the Department of
 4   Transportation's Harbors Division as public lands, to identify
 5   any harbors over which the Harbors Division should have
 6   jurisdiction and be authorized to dispose of by leases,
 7   easements, revocable permits, and construction rights; and
 8   
 9        BE IT FURTHER RESOLVED that the Auditor's analysis and
10   review should identify lands that should be transferred to the
11   Harbors Division's jurisdiction and control by Executive Order
12   for efficient planning and development of harbor lands.  The
13   Auditor is requested to identify the harbors most likely to be
14   capable of generating income for the State by using the back-up
15   lands around the State's harbors for maritime activities and
16   for nonmaritime ancillary or supportive uses; and
17   
18        BE IT FURTHER RESOLVED that the Auditor is requested to
19   report findings and recommendations to the Legislature no later
20   than twenty days before the convening of the Regular Session of
21   2001; and 
22   
23        BE IT FURTHER RESOLVED that certified copies of this
24   Concurrent Resolution be transmitted to the Auditor, the
25   Director of Transportation, and the Chairperson of the Board of
26   Land and Natural Resources.
