                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING A FEASIBILITY STUDY ON THE TRANSFER OF THE HARBOR
    ENFORCEMENT PROGRAM FROM THE DEPARTMENT OF TRANSPORTATION
    TO THE DEPARTMENT OF PUBLIC SAFETY. 


 1        WHEREAS, the Harbor Enforcement Program (Program) consists
 2   of twenty-two positions eighteen of which exist under the Oahu
 3   District Enforcement Section including; one at Deputy Sheriff
 4   IV Lieutenant, three at Deputy Sheriff III Sergeant, thirteen
 5   at Deputy Sheriff II Officer, and one Clerk Typist III; and
 6   
 7        WHEREAS, prior to July 1, 1991, the Program fell under the
 8   jurisdiction and funding of the Department of Transportation-
 9   Harbors Division; and
10   
11        WHEREAS, from July 1, 1991, through June 30, 1996, the
12   Program, by Legislative Act, was transferred to the
13   jurisdiction of the Department of Public Safety with funding
14   provided by the Department of Transportation-Harbors Division;
15   
16        WHEREAS, from July 1, 1996, to the present, by Legislative
17   Act, the Program was transferred back to the Department of
18   Transportation due to the alleged, inappropriate use of funds
19   not specified for Department of Transportation-Harbors Division
20   programs; and
21   
22        WHEREAS, an additional problem is that the Department of
23   Transportation-Harbors Division is not a law enforcement agency
24   and does not have the sufficient law enforcement background,
25   and resources to address law enforcement issues in a manner
26   consistent with the Program; and
27   
28        WHEREAS, this discrepancy in law enforcement training is a
29   potential cause of dissension between the personnel of the
30   Department of Transportation-Harbors Division and the personnel
31   of the Program; and
32   
33        WHEREAS, a probable source of the funding shortfall
34   problems in the past was due to the Department of
35   Transportation monitoring co-mingled programs consisting of

 1   both general and special funded positions; and
 2   
 3        WHEREAS, currently, no other programs are co-mingled with
 4   the Program which may alleviate any funding problems should the
 5   Program be transferred to the Department of Public Safety; and
 6   
 7        WHEREAS, transferring the Program may increase the
 8   effectiveness and efficiency of law enforcement service
 9   provided to the maritime community and tenants or users of
10   commercial harbors; now, therefore,
11   
12        BE IT RESOLVED by the Senate of the Twentieth Legislature
13   of the State of Hawaii, Regular Session of 2000, the House of
14   Representatives concurring, that the Auditor is requested to
15   conduct a feasibility study of the transfer of the Harbor
16   Enforcement Program from the Department of
17   Transportation-Harbors Division to the Department of Public
18   Safety; and
19   
20        BE IT FURTHER RESOLVED that the Auditor is requested to
21   report findings and recommendations to the Legislature twenty
22   days before the convening of the Regular Session of 2001; and
23   
24        BE IT FURTHER RESOLVED that certified copies of this
25   Concurrent Resolution be transmitted to the Auditor, Department
26   of Transportation, and Department of Public Safety.
