                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING A SUNRISE REVIEW OF THE REGULATION OF GEOLOGISTS. 


 1        WHEREAS, geology may be described as a science that
 2   studies the earth in general, including the investigation of
 3   the earth's crust and the rocks and other materials which
 4   compose it; and
 5   
 6        WHEREAS, geologists apply various scientific procedures in
 7   their studies, utilizing knowledge of the earth and its
 8   constituent rocks, minerals, liquids, gases, and other
 9   materials, through methods of applied science that are
10   recognized by professional authorities in the field of geology;
11   and
12   
13        WHEREAS, the Hawaiian Islands form a unique repository of
14   geological resources that may benefit the people of Hawaii and
15   mankind in general; and
16   
17        WHEREAS, the geological resources of the Hawaiian Islands
18   are also limited and any use of these resources must be
19   carefully considered for impacts on fragile environmental
20   resources; and
21   
22        WHEREAS, currently in the State of Hawaii, a person may
23   hold oneself out as able to perform professional services
24   requiring the application of geological methods and principles;
25   and
26   
27        WHEREAS, while professional standards are based on
28   educational requirements and experience in the field of
29   geology, the State of Hawaii does not regulate geologists and
30   regulation of the profession of geology is needed to protect
31   the State's unique geological resources; and
32   
33        WHEREAS, Senate Bill No.      was introduced during the
34   Regular Session of 2000 as a vehicle to provide for the
35   regulation of geologists as a profession; and
36   
37        WHEREAS, section 26H-6, Hawaii Revised Statutes, requires

 1   that new regulatory measures being considered for unregulated
 2   professions or vocations be referred to the Auditor for
 3   analysis of the probable effects of the proposed regulatory
 4   measure and assess whether the enactment is consistent with the
 5   policies set forth in section 26H-2, Hawaii Revised Statutes,
 6   and also assess alternative forms of regulation; now,
 7   therefore,
 8   
 9        BE IT RESOLVED by the Senate of the Twentieth Legislature
10   of the State of Hawaii, Regular Session of 2000, the House of
11   Representatives concurring, that the Auditor perform a sunrise
12   review of the regulation of geologists as provided for in S.B.
13   No.     , introduced during the Regular Session of 2000; and
14   
15        BE IT FURTHER RESOLVED that the Auditor is requested to
16   submit its findings and recommendations to the Legislature no
17   later than twenty days prior to the convening of the Regular
18   Session of 2001; and
19   
20        BE IT FURTHER RESOLVED that a certified copy of this
21   Concurrent Resolution be transmitted to the Auditor.
