                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE DEPARTMENT OF TRANSPORTATION TO CONDUCT A STUDY
    ON THE FEASIBILITY OF IMPLEMENTING A ONE-CALL SYSTEM TO
    LOCATE UNDERGROUND FACILITIES.



 1        WHEREAS, S.B. No. 2285 would have required the Public
 2   Utilities Commission (PUC) to establish a one-call system in
 3   which all owners of underground facilities would be required to
 4   participate, and under which an entity proposing to do
 5   excavation would be required to provide prior notice to the
 6   system; and 
 7   
 8        WHEREAS, the one-call system would then locate underground
 9   facilities in the area of the proposed excavation; and
10   
11        WHEREAS, concerns were raised at the hearing on this
12   measure, including concerns that the PUC was not the
13   appropriate agency to administer the system, the measure
14   affects entities outside of the PUC's jurisdiction, mandating
15   the utilities' participation in the system would increase
16   utility rates, the State does not have the resources to mark
17   its underground facilities, and the measure lacks penalty and
18   funding provisions; and
19   
20        WHEREAS, further study of a one-call system is warranted
21   to address these concerns and to overcome the barriers to the
22   establishment of a one-call system; now, therefore,
23   
24        BE IT RESOLVED by the Senate of the Twentieth Legislature
25   of the State of Hawaii, Regular Session of 2000, the House of
26   Representatives concurring, that the Department of
27   Transportation is requested to convene a working group to study
28   the feasibility of establishing a one-call system; and
29   
30        BE IT FURTHER RESOLVED that the working group include
31   representatives from the Division of Consumer Advocacy, the
32   Department of Health, the Public Utilities Commission, the
33   Board of Water Supply, the counties, the General Contractors
34   Association, Life of the Land, the utility industry, the
35   gasoline and oil industries, USA North, and the cable

 1   television industry; and
 2   
 3        BE IT FURTHER RESOLVED that the working group submit its
 4   findings and recommendations, including any proposed
 5   legislation, to the Legislature no later than twenty days
 6   before the convening of the Regular Session of 2001; and
 7   
 8        BE IT FURTHER RESOLVED that certified copies of this
 9   Concurrent Resolution be transmitted to the Director of
10   Transportation, the Public Utilities Commission, the Consumer
11   Advocate, the Director of Health, the Chairs of the Board of
12   Water Supply for each county, the Directors of Transportation
13   and Public Works for each county, the General Contractors
14   Association, Life of the Land, USA North, the various utility
15   companies, the major gas and oil companies, and cable
16   television companies.
