                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE DEPARTMENT OF COMMERCE AND CONSUMER AFFAIRS TO
    EVALUATE EXISTING CONSTRUCTION LAWS AND PRACTICES RELATING
    TO NEW RESIDENTIAL OWNERS WHO REQUIRE REMEDIAL WORK. 


 1        WHEREAS, the purchase of a new home is the largest
 2   purchase made by most Hawaii residents and consumers; and
 3   
 4        WHEREAS, when the purchase involves a newly-constructed
 5   home, remedial work is sometimes required after the sale; and
 6   
 7        WHEREAS, the relative responsibilities of the parties
 8   regarding remedial work is sometimes unclear, may involve many
 9   different contractors, and may involve third party warranties;
10   and
11   
12        WHEREAS, the relative responsibilities of the parties
13   regarding remedial work is often dictated by standard industry
14   practice in a manner that may be unclear to consumers; now,
15   therefore,
16   
17        BE IT RESOLVED by the Senate of the Twentieth Legislature
18   of the State of Hawaii, Regular Session of 2000, the House of
19   Representatives concurring, that the Department of Commerce and
20   Consumer Affairs (DCCA) is requested to evaluate existing
21   construction laws and practices, evaluate the extent of the
22   protection provided to purchasers of new residential property
23   requiring remedial work, and offer possible solutions that will
24   enhance the existing level of protection; and
25   
26        BE IT FURTHER RESOLVED that in its inquiry, the DCCA is
27   requested to collaborate with members of the construction
28   industry and related industries and report its findings and
29   recommendations to the Legislature no later than twenty days
30   prior to the convening of the Regular Session of 2001; and
31   
32        BE IT FURTHER RESOLVED that certified copies of this
33   Concurrent Resolution be transmitted to the Director of
34   Commerce and Consumer Affairs, the General Contractors
35   Association of Hawaii, the Building Industry Association of
