                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE AUDITOR TO REVIEW THE POLICIES OF THE DEPARTMENT
    OF EDUCATION FOR PROCUREMENT OF PROFESSIONAL SERVICES. 


 1        WHEREAS, the Department of Education (Department), for the
 2   procurement of professional services, is subject to the
 3   requirements set forth in Section 103D-304, Hawaii Revised
 4   Statutes (HRS); and
 5   
 6        WHEREAS, with respect to procurements for professional
 7   services, Section 103D-304, HRS, does not define an agency's
 8   "need" for professional services or when professional services
 9   should be sought; and
10   
11        WHEREAS, given the often extensive experience and
12   qualifications of the staff of the Department, it may be
13   unnecessary and duplicative for the Department to procure
14   professional and consultative services for particular
15   situations; and
16   
17        WHEREAS, in light of the State's current economic
18   weakness, strict attention must be paid to ensuring government
19   efficiency and discouraging procurements for services which
20   could have been performed by the staff of a state agency or
21   department; now, therefore,
22   
23        BE IT RESOLVED by the Senate of the Twentieth Legislature
24   of the State of Hawaii, Regular Session of 2000, the House of
25   Representatives concurring, that the Auditor is requested to
26   review the Department of Education's policies for the
27   procurement of professional services; and
28   
29        BE IT FURTHER RESOLVED that the Auditor is requested to
30   report findings and recommendations to the Legislature no later
31   than twenty days prior to the convening of the Regular Session
32   of 2001; and
33   
34        BE IT FURTHER RESOLVED that certified copies of this
35   Concurrent Resolution be transmitted to the Auditor and the
36   Superintendent of Education.
