                   A  BILL  FOR  AN  ACT

RELATING TO TEACHERS IN RURAL AREAS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to subpart D of part III to be
 
 3 appropriately designated and to read as follows:
 
 4      "§302A-     Long term substitute teachers; rural area
 
 5 exemption.  (a)  A noncertificated long term substitute teacher
 
 6 employed by a rural school district in a county whose population
 
 7 is less than 200,000 shall be exempt from the length of service
 
 8 limitations adopted by the teacher standards board for long term
 
 9 substitute teachers; provided that the term of employment of the
 
10 noncertificated long term substitute teacher shall not exceed one
 
11 calendar year.
 
12      (b)  A noncertificated long term substitute teacher employed
 
13 by a rural school district in a county whose population is less
 
14 than 200,000 may appeal to the teacher standards board for an
 
15 extension of the one year term of employment authorized under
 
16 subsection (a).  Upon good cause shown by the appellant, the
 
17 teacher standards board may extend the appellant's term of
 
18 employment; provided that the extension shall not exceed one
 
19 additional calendar year.  A noncertificated long term substitute

 1 teacher whose term of employment accrues to a total of two
 
 2 calendar years shall not be eligible for any additional exemption
 
 3 or further extension."
 
 4      SECTION 2.  The University of Hawaii shall establish and
 
 5 operate a remote teacher certification program on the island of
 
 6 Lanai.  The remote teacher certification program may employ the
 
 7 University of Hawaii's HITS network facilities and equipment and
 
 8 is encouraged to utilize the most cost effective means available
 
 9 of providing teacher certification to remote areas.
 
10      SECTION 3.  There is appropriated out of the general
 
11 revenues of the State of Hawaii the sum of $         , or so much
 
12 thereof as may be necessary for fiscal year 1999-2000, for the
 
13 purpose of establishing and operating a remote teacher
 
14 certification program on the island of Lanai.
 
15      SECTION 4.  The sum appropriated shall be expended by the
 
16 University of Hawaii for the purposes of this Act.
 
17      SECTION 5.  The University of Hawaii shall submit a report
 
18 on the status and implementation of the remote teacher
 
19 certification program to the legislature not later than twenty
 
20 days prior to the convening of the 2000 regular session.
 
21      SECTION 6.  New statutory material is underscored.
