Transportation of Students


DESCRIPTION:
Requires the department of education to provide suitable
transportation for students:  (1) in rural areas without public
transportation so that the students may participate in
sanctioned, organized extra-curricular school activities; and (2)

                   A  BILL  FOR  AN  ACT

RELATING TO THE TRANSPORTATION OF PUBLIC SCHOOL STUDENTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to subpart C of Part II to be
 
 3 appropriately designated and to read as follows:
 
 4      "§302A-     Transportation of public school students for
 
 5 sanctioned, organized extra-curricular school activities.  (a)
 
 6 The department, contingent on the availability of funds, shall
 
 7 provide suitable transportation for sanctioned, organized extra-
 
 8 curricular school activities for public school students who
 
 9 reside in rural areas without public transportation.
 
10      (b)  The department shall adopt such policies, procedures,
 
11 and programs as it deems necessary to provide public school
 
12 students residing in rural areas without public transportation
 
13 with substantially equal opportunities to participate in
 
14 sanctioned, organized extra-curricular school activities as are
 
15 enjoyed by students residing in areas where public transportation
 
16 is available.  In formulating the policies, procedures, and
 
17 programs, the department shall consider:
 
18      (1)  The school district;
 
19      (2)  The school attendance area in which a student normally

 1           resides;
 
 2      (3)  The distance the student lives from the school;
 
 3      (4)  The availability of public carriers or other means of
 
 4           transportation;
 
 5      (5)  The frequency, regularity, and availability of public
 
 6           transportation;
 
 7      (6)  The grade level, physical handicap, or special learning
 
 8           disability of the student;
 
 9      (7)  The ability of the student to participate in
 
10           sanctioned, organized extra-curricular school
 
11           activities; and
 
12      (8)  Any conditions and circumstances unique or peculiar to
 
13           a county or area.
 
14      (c)  The department shall adopt rules under chapter 91
 
15 governing the supervision and administration of the
 
16 transportation of public school students for sanctioned,
 
17 organized extra-curricular school activities."
 
18      SECTION 2.  Section 302A-406, Hawaii Revised Statutes, is
 
19 amended to read as follows:
 
20      "[[]§302A-406[]]  Transportation of public school
 
21 [children.] students.  (a)  The department [may], contingent on
 
22 the availability of funds, shall provide suitable transportation
 
23 [to]:

 1      (1)  To and from school [and for]; and
 
 2      (2)  For educational field trips;
 
 3 for all [children] public school students in grades kindergarten
 
 4 to twelve and in special education classes.
 
 5      (b)  The department shall adopt [such policy, procedure, and
 
 6 program] policies, procedures, and programs as it deems necessary
 
 7 to provide suitable transportation.  In formulating the [policy,
 
 8 procedure, and program,] policies, procedures, and programs, the
 
 9 department shall consider [the]:
 
10      (1)  The school district; [the]
 
11      (2)  The school attendance area in which a [school child]

 5      SECTION 3.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 4.  This Act shall take effect upon its approval.
