Establishes an advisory committee to assist the board of
examiners in naturopathy in determining the applicable formulary
for the use of prescription drugs in natural medicine.

                   A  BILL  FOR  AN  ACT

RELATING TO NATUROPATHY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 455, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§455-     Joint formulary advisory committee established.
 
 5 The department shall establish a joint formulary advisory
 
 6 committee composed of:
 
 7      (1)  Two persons licensed as naturopathic physicians;
 
 8      (2)  Two persons licensed as pharmacists; and
 
 9      (3)  Two persons licensed in medicine by the board of
 
10           medical examiners.
 
11 The joint formulary advisory committee shall recommend the
 
12 applicable formulary for persons licensed under this chapter
 
13 relative to prescription drugs encompassed within "natural
 
14 medicine" as defined in section 455-1.  The board of examiners in
 
15 naturopathy shall adopt the formulary as established by the joint
 
16 formulary advisory committee in its rules."
 
17      SECTION 2.  Section 455-1, Hawaii Revised Statutes, is
 
18 amended by amending the definition of "natural medicine" to read
 
19 as follows:

 1      ""Natural medicine" encompasses substances of botanical,
 
 2 mineral, and animal origin, homeopathic preparations thereof, and
 
 3 substances, including prescription drugs, whose natural state has
 
 4 been improved by any process that does not substantially alter
 
 5 the molecular structure found in nature, or prescription drugs
 
 6 manufactured to be identical in molecular structure to substances
 
 7 found in nature, including vitamins, minerals, [and] amino
 
 8 acids[;], fatty acids, and other naturally derived prescription
 
 9 drugs or their synthetic analogs as established by the joint
 
10 formulary advisory committee and adopted by the board; excluding
 
11 narcotic prescription drugs[, with the following exceptions:
 
12 vitamins, minerals, amino acids, and fatty acids]."
 
13      SECTION 3.  There is appropriated out of the general
 
14 revenues of the State of Hawaii the sum of $       , or so much
 
15 thereof as may be necessary for fiscal year 1999-2000, to assist
 
16 the advisory committee in establishing the applicable formulary.
 
17      The sum appropriated shall be expended by the department of
 
18 commerce and consumer affairs for the purposes of this Act.
 
19      SECTION 4.  Statutory material to be repealed is bracketed.
 
20 New statutory material is underscored.
 
21      SECTION 5.  This Act shall take effect upon its approval.
